“Callous disregard” for workers’ safety lands boss in jail

A businessman has been jailed for six months after a casual labourer narrowly avoided death on his building site.

Slovakian Dusan Dudi was one of several migrant workers employed by 36-year-old Shah Nawaz Pola to build an extension at a house on Allerton Road, Bradford. They were paid £30 a day in cash.

While working on his own to demolish a wall in November 2005, Dudi suffered what were thought to be non-survivable injuries when he was struck by a concrete lintel. He somehow survived after his life support machine was switched off in hospital. Bradford Crown Court was told that although Dudi has safely returned to Slovakia, he is in need of constant care and will probably never work again.

At the site, there was no proper scaffolding in place, and Dudi was working on an improvised working platform, which was just two planks wide. The workers had not been given any protective clothing or training, the court heard.

Pola, of Heaton, Bradford, denied being in charge of the building site, but was convicted of breaches of s2 of the HSWA regarding the health and safety of employees, and regulation 6(3) of the Work At Height Regulations. He was also found guilty of breaching a prohibition notice, served on 29 November 2005, after the incident.

Sentencing him to six months in prison on 7 August, Judge Peter Benson said Pola had decided to have the work done as cheaply as possible, regardless of the consequences for the people he chose to do it. He said: “You showed a callous disregard for the safety of your workers,” adding: “You are a very capable, clever and cunning individual who is completely ruthless about pursuing your own aims at the expense of those to whom you have a duty of care.”

Pola was fined £750 for the s2 charge, and £750 for the WAH charge. He was ordered to pay £90,000 in compensation to Dudi, 25 per cent of which has to be paid within six months.

After the hearing, Pola’s solicitor, Abdul Iftikhar, revealed that an appeal was being lodged against both the conviction and sentence. Mr Iftikhar said: “Mr Pola maintains his innocence, as he has done throughout these proceedings, and both the conviction and now the sentence will be the subject of appeal.”
